Final Annexation Merit Hearing Daily Updates


June 24, 2015 (Day 13 - Final Day)

The Municipal Government Board (MGB) heard a summary from the City of Edmonton's legal representation as an affected party until 10:30 a.m. Next, the Town of Beaumont's legal representation began their final legal argument to the MGB until the lunch break.

After lunch, the MGB heard the final legal arguments from both the Town of Beaumont and Leduc County's legal representations until 3:56 p.m. The Town was provided one last opportunity to rebuttal the County's closing legal argument.

The MGB closed the hearing at 4:30 p.m.

What's next? The MGB panel will read and review all written and oral submissions and formulate a recommendation to the Minister of Municipal Affairs. Then the Minister will make a recommendation to Cabinet and then Cabinet (Province) will make the decision. The Board Chair did not indicate exactly how long this would take, however it is likely to be several months. In the Town's application the effective date of Annexation was requested to be 2016-01-01. If the Town is successful, the effective date of annexation may be extended to a later date pending the time taken for the Province to reach a decision.

June 23, 2015 (Day 12)


The morning began with the Town's legal representation cross examining David Hales, Executive Director, Regional Planning for the City of Edmonton until 11:10 a.m. The County's legal representation completed their cross examination of Mr. Hales just before the lunch break. The Municipal Government Board (MGB) asked questions of clarity and will resume further questioning after the lunch break.

After the lunch break the MGB panel continued asking questions of clarity of Mr. Hales. There was further cross examination questions from the Town's legal representation of Mr. Hales. There was a redirect by the City of Edmonton's legal representation. Mr. Hales finished at 1:35 p.m.

The MGB provided one last opportunity for landowners to present at the hearing. There was one Leduc County landowner outside of the annexation area that spoke of concerns of the proposed annexation. Also, the Chairperson of the Leduc County Coalition and Business/Landowner in Nisku that spoke in opposition to the City of Edmonton annexation and spoke of concerns of Beaumont's proposed annexation, but generally supportive.

The schedule for the remainder of the Hearing is as follows:
  • Wednesday morning the City of Edmonton will present its final legal summary.
  • Closing legal arguments from the County and Town will be presented after the City of Edmonton in the afternoon.
  • MGB will present any closing remarks.
The MGB adjourned at 3:06 p.m. until tomorrow morning at 10 a.m.

June 22, 2015 (Day 11)


The Municipal Government Board (MGB) resumed the third week of the hearing continuing with the presentation from Peter Nichols, the City of Edmonton's Financial and Economic consultant and author of the Review of Growth Requirements and Impacts and the City of Edmonton Growth Study until 11 a.m. After the morning break the Town's legal representation began their cross examination until the lunch the break.

After lunch, the Town's legal representation finished their cross examination of Mr. Nichols at 2:30 p.m. The County's legal representation cross examined Mr. Nichols until 3 p.m. There were no questions from the MGB panel and no redirect.

The City of Edmonton called their second witness Herb Kuehne, the City of Edmonton's professional engineering consultant and author of the Beaumont Annexation Infrastructure Serviceability Review. The Town's legal representation completed their cross examination of Mr. Kuehne by 4:08 p.m. The County's legal representation finished their cross examination of Mr. Kuehne at 4:20 p.m. The MGB asked questions of clarity.

The City of Edmonton called their third and final witness David Hales, Executive Director, Regional Planning for the City of Edmonton. The MGB adjourned at 5:11 p.m. The cross examination of Mr. Hales will occur tomorrow and there will be one last landowner session on Tuesday 2015-06-23.

The anticipated schedule for the remainder of the Hearing:
  • Tuesday morning Mr. Hales will be cross examined and the MGB will allow one last opportunity for landowners to speak in the afternoon.
  • The City of Edmonton will present its final legal summary.
  • Closing legal arguments from the County and Town will be presented on Wednesday morning and afternoon if necessary.
  • MGB will present any closing remarks.

June 19, 2015 (Day 10)


In the morning, the County called their fourth and final witnesses Darryl Howery and Drina Schneider, the County's Financial consultants and authors of the Fiscal Impact Analysis, presented their evidence to the Municipal Government Board (MGB) until the lunch break.

After lunch Mr. Howery and Ms. Schneider continued with their presentations to the MGB until 2:15 p.m. The Town's legal representation completed its cross examination of Mr. Howery and Ms. Schneider by 3:15 p.m. There was a redirect by the County's legal representation. This concludes the County's witnesses for this hearing.

The City of Edmonton called their first witness Peter Nichols, the City of Edmonton's Financial and Economic consultant and author of the Review of Growth Requirements and Impacts and the City of Edmonton Growth Study. The Town and the County objected to Peter Nichols being an expert in Planning and Land Use matters. The MGB determined that they would weigh his evidence relating to Planning as a non-expert.

The MGB adjourned at 4:40 p.m. as it was a logical break in Mr. Nichols presentation and will resume on Monday 2015-06-22 with continuing to hear evidence from Mr. Nichols.



June 18, 2015 (Day 9)


The day resumed with Nathan Petherick, the County's Planning consultant and author of the B&A Planning Group Review of Beaumont Growth Study continuing to present evidence to the Municipal Government Board (MGB). The Town's legal representation began its cross examination of Mr. Petherick at 10:30 a.m.

After lunch the cross examination of Mr. Petherick continued until 4:20 p.m. The City of Edmonton's legal representation asked questions of clarity. The MGB asked questions of Mr. Petherick. There was a redirect by the County.

The County will be calling their final witness Darryl Howery, the County's Financial consultant and author of the Fiscal Impact Analysis tomorrow morning. The MGB adjourned at 5:05 p.m.

June 17, 2015 (Day 8)


The Municipal Government Board (MGB) resumed the hearing after adjourning from the landowner evening session yesterday with continuing the Town's cross examination of Phil Newman, Inter-government Advisor, Leduc County until the lunch break.

After lunch the MGB asked questions of Mr. Newman. There was a redirect by both legal representations from the Town and County.

The County called their second witness Ryan Betker, a professional engineer with McElhanney to present information on the general servicing around Beaumont. The Town's legal representation cross examined Mr. Betker. The MGB asked questions of clarity to Mr. Betker.

The County called their third witness Nathan Petherick, the County's Planning consultant and author of the B&A Planning Group Review of Beaumont Growth Study. The MGB adjourned at 5:04 p.m. and will resume in the morning with continuing to hear evidence from Mr. Petherick.

June 16, 2015 (Day 7)


The Municipal Government Board (MGB) resumed the hearing with continuing to hear evidence from Phil Newman, Inter-government Advisor, Leduc County. The Town's legal representation began their cross examination of Mr. Newman just prior to lunch.

After lunch the Town's legal representation continued with cross examination of Mr. Newman. The County's legal representation objected to the line of questioning regarding densities with regards to East Vista's Local Area Structure Plan. The MGB considered the objection and agreed that no further questions related to density on East Vista's will be asked but could continue with questions about population projections of East Vista's and the County following the Capital Region Growth Plan (CRGP) in Priority Growth Area Ce.

The MGB adjourned at 3:30 p.m. for a break and will reconvene at 5:30 p.m. for the landowner session.

The MGB opened the landowners evening session at 5:30 p.m. until 8:15 p.m. There were 8 presentations made by landowners in the proposed annexation to the MGB. All presentations were in support of the Town's annexation.

June 15, 2015 (Day 6)


The Municipal Government Board (MGB) resumed the hearing with Leduc County's legal representation continuing their cross examination of Tom Cooper, Financial Consultant and co-author of the Financial Impact Analysis. The MGB panel asked questions of Mr. Cooper.

After lunch the Town called Hassan Shaheen, a professional engineer who spoke to the Transportation services for the Town and the proposed annexation area. Leduc County's legal representation began their cross examination of Mr. Shaheen. The City of Edmonton's legal representation asked questions of clarity. The MGB panel asked questions of Mr. Shaheen.

The Town called its final witness Barry Raynard, a professional engineer who spoke to the Water, Wastewater and Stormwater services in relation to the Town's proposed annexation and the City of Edmonton's annexation notice. Mr. Raynard was cross examined by Leduc County's legal representation. The City of Edmonton's legal representation asked questions of clarity of Mr. Raynard.

After the afternoon break Leduc County called its first witness, Phil Newman, Inter-government Advisor, Leduc County. The MGB adjourned and will reconvene tomorrow morning with Mr. Newman.

There is one more landowner evening session scheduled for Tuesday, 2015-06-16 at 5:30 p.m. with registration commencing at 5 p.m.

June 12, 2015 (Day 5)


The Municipal Government Board (MGB) resumed the hearing with continuing to hear evidence from Tom Cooper, Financial Consultant and co-author of the Financial Impact Analysis. Leduc County's legal representation began their cross examination of Mr. Cooper.

After lunch the Town called Les Kruszewski, a professional engineer who spoke to the stormwater services for the Town and the proposed annexation area. Leduc County's legal representation began their cross examination of Mr. Kruszewski. The City of Edmonton's legal representation asked questions of clarity. The MGB panel asked questions of Mr. Kruszewski.

The MGB adjourned until Monday and will continue with the cross examination Mr. Cooper on Monday 2015-06-15 in the morning. The Town will be calling 2 more witnesses early next week.

Leduc County's legal representation indicated that they will be calling 4 witnesses and the City of Edmonton will be calling 3 witnesses to give a brief presentation to the MGB panel.

There is one more landowner evening session scheduled for Tuesday, 2015-06-16 at 5:30 p.m. with registration commencing at 5 p.m.

June 11, 2015 (Day 4)


The Municipal Government Board (MGB) started off the morning with restating the scheduling of the merit hearings for the remainder of the week. The hearing will adjourn no later than 3:30 p.m. today and resume in the evening at 6 p.m. for the landowner presentations at 6:30 p.m. On Friday 2015-06-15 the hearing will adjourn at 2:30 p.m. due to the room being unavailable.

The MGB provided a decision on the City of Edmonton's preliminary application to question the witnesses. The decision was to allow the City of Edmonton to ask questions of clarification only, but not a cross examination.

The MGB heard evidence from the Town's third witness, Ahtesham Shirazi, a professional engineer, who spoke to the water and wastewater services for the Town and the proposed annexation area. Leduc County's legal representation completed their cross examination of Ahtesham Shirazi and then the City of Edmonton legal representation asked questions of clarity.

Darren Young, the Town's Planning Consultant and author of the 2014 ISL Growth Study update was asked to resume providing evidence and was questioned by the City of Edmonton's legal representation. The MGB panel continued with questions of Mr. Young as well. The MGB panel allowed further questioning of Mr. Young by the County's legal representation.

In the afternoon the MGB heard from the Town's fourth witness, Connie Gourley, a professional planner who gave evidence regarding the Capital Region Growth Plan. Ms. Gourley was cross examined by the County's legal representation.

The Town called Tom Cooper, Financial Consultant and co-author of the Financial Impact Analysis to provide evidence. The MGB adjourned Mr. Cooper's testimony and he will resume tomorrow morning.

The MGB opened the landowners evening session at 6:30 p.m. until 8 p.m. There were three presentations made by landowners in the proposed annexation to the MGB. All presentations were in support of the Town's annexation application.

June 10, 2015 (Day 3)


The hearing resumed in the morning with the Municipal Government Board (MGB) continuing to hear evidence from Darren Young, the Town's Planning Consultant and author of the 2014 ISL Growth Study update.

MGB panel asked some questions prior to the County's legal representation.

After lunch the City of Edmonton's legal representation asked the MGB if it can ask the witnesses questions during the proceedings. The MGB panel communicated that it would rule on matter after the County's legal representation cross examination was completed.

The County's legal representation began its cross examination of Darren Young until 4:50 p.m. The MGB communicated that they will provide a decision in the morning regarding the City of Edmonton's request to question witnesses.

June 9, 2015 (Day 2)


The Municipal Government Board (MGB) heard a preliminary application submitted by the County's legal representation regarding the City of Edmonton intervener submission as it pertains to the City of Edmonton's attempts to support their annexation in their submission at these merit hearings. The Town's legal representation supports this preliminary application.

City of Edmonton legal representation argued their concern for the MGB to only hear Town and County evidence. They made comments about municipalities racing to submit their annexation applications. City of Edmonton expressed it is important to give evidence of its growth needs in this region. Edmonton does not have a timeline for negotiation and/or mediation.

MGB decision was presented before lunch and determined Edmonton is an affected party and the MGB will consider all evidence presented in accordance with Principle 2 of the Annexation Principles and the 2014-09-18 MGB Preliminary decision letter.

After lunch Mr. McCartney was cross examined by the County's legal representation until just after 4 p.m.

The MGB began to hear evidence from the Town's second witness, Darren Young, the Town's Planning Consultant and author of the 2014 ISL Growth Study update. They adjourned at 4:55 p.m. and will reconvene at 10 a.m. tomorrow.


June 8, 2015 (Day 1)


This was the first day of the Final Annexation Merit Hearing.

There are 5 members from the Municipal Government Board (MGB) to hear the annexation application. The MGB developed a hearing schedule that is subject to change. Landowners are given 2 evenings to make their presentation: Thursday 06-11 at 6:30 p.m. and Tuesday 06-16 at 5:30 p.m.

Opening remarks were made by the Town and County legal representation in the morning. There was 1 landowner outside of the annexation area to the east that made presentation in the morning.

After lunch the MGB heard evidence from the Town's first witness, Mr. Dean McCartney, Municipal Planner. A cross examination of Mr. McCartney was postponed for tomorrow at the request of the County's legal representation.

Two landowner representatives outside of the annexation area to the east made presentation to the MGB. All landowner presentations made today stated they wanted that their lands be included in the proposed annexation area and asked that servicing be designed to accommodate growth to the east in the future.

November 25, 2014


The Town of Beaumont Council passed a resolution to release the updated ISL Growth Study (PDF) and Financial Impact Analysis (PDF) to support the Annexation Application. These updates were completed to address concerns raised during consultation and mediated discussions with Leduc County.

October 20, 2014


The Municipal Govenment Board (MGB) sent a Notice of Decision (PDF) pertaining to the 2014-09-18 Preliminary Hearing. This letter confirms the oral instructions from the MGB that were stated at the 2014-09-18 Preliminary Hearing.

September 18, 2014


The Municipal Government Board (MGB) conducted a Preliminary Hearing on 2014-09-18. Submissions received prior to the MGB Preliminary Hearing are available by viewing the Preliminary Hearing Submissions (PDF). The MGB has scheduled the Merit Hearings, on the proposed annexation, for 06-08 to 26, 2015. The MGB will be providing an official letter to the Town of Beaumont and Leduc County confirming dates.

July 3. 2014

Beaumont formally announces its intention to move forward by making an annexation application to the Municipal Government Board. Beaumont will reduce its request from 24 to 21 quarter sections and slightly change the target area based on the feedback received from public consultation, mediated discussions with Leduc County, and the City of Edmonton's annexation proposal.
