Municipal Reserve Disposal FAQ

Q.        What is a municipal reserve?

A.        A municipal reserve is a type of land dedicated, usually at the time of subdivision, for a public park, recreation area, school board purpose or to separate lands that are used for different purposes (e.g. as a buffer).


Q.        What is a MR (municipal reserve) designation?

A.        A MR designation is assigned by the Alberta Land Titles Office when the municipal reserve title is registered at land titles (e.g. Plan 182 1234, Block 5, Lot 6MR).  This identifies the land specifically as municipal reserve. The use of municipal reserve is governed by the Municipal Government Act.

Q.        When did the Town decide to use Parc Beacon Park for the St. Jacques Heritage House? 

A.        In September of 2011, Council passed a resolution to approve the use of Parc Beacon Park (3116-49 Street) by the Beaumont & District Heritage Society for the relocation of the St. Jacques Heritage House.  A sign indicating the future relocation of the heritage house to Parc Beacon Park has been on the site since about July, 2012.

Q.        Why is the Town removing the MR (municipal reserve) designation from Parc Beacon Park?

A.        The Town proposes to lease to the Beaumont & District Heritage Society the park lands for the relocation and use of the St. Jacques Heritage House.  The heritage house is not municipally owned or operated and a lease is required to govern the use of the lands.  The Municipal Government Act requires a municipality to dispose of or remove the MR designation prior to entering into a lease for use of the land.

Q.        Why is the Town holding a Public Hearing?

A.        A public hearing is being held in accordance with the Municipal Government Act to hear from affected parties regarding the removal of the MR (municipal reserve) designation.

Q.        How were people notified about the Public Hearing?

A.        An advertisement was placed in the June 1 and June 8 editions of the Beaumont News, letters were hand delivered to homeowners with properties within 100m radius of Parc Beacon Park, and a sign was placed on the Parc Beacon Park site advising of the Public Hearing.

Q.        I received a letter that advised of two (2) Public Hearings.  What is the other Public Hearing being held for?

A.        The other Public Hearing affecting the same residents is in relation to a Land Use Bylaw amendment for the PRS – Public Recreation Services District.  Parc Beacon Park is zoned PRS – Public Recreation Services and in order to permit the Beaumont & District Heritage Society to use the lands for the intended purpose a text amendment to the PRS – Public Recreation District is required to add “Community Centres” as a permitted use.  A Public Hearing is required prior to 2nd & 3rd reading of the bylaw amendment.
